On June 9th, the Court entered a Final Judgment approving the Settlement.  You can review the Final Judgment by clicking on the Court Documents link.  

The Claims Administrator is currently reviewing filed claims.  We expect that any deficiency letters regarding filed claims will go out over the next couple of months.   We will update this website with regard to the claims process as we get closer to distribution of the Settlement Fund. 


The information contained on this web page is only a summary of information presented in more detail in the Notice of (I) Proposed Class Action Settlement; (II) Settlement Fairness Hearing; and (III) Motion for Attorneys’ Fees and Litigation Expenses (the “Notice”), which you can access by clicking here.  Since this website is just a summary, you should review the Notice for additional details. 

  • The Notice describes important rights you may have and what steps you must take if you wish to participate in the Settlement or wish to be excluded from the Class.
  • The Settlement, if approved by the Court, will provide a total recovery of $1,225,000 in cash for the benefit of the Settlement Class (described below), less any deduction for Court-approved attorneys’ fees and expenses, notice and administrative costs, and taxes. In addition, the Settlement provides for an assignment of a portion of a multimillion-dollar claim held by one of the settling defendants. 
  • The Settlement resolves claims by Plaintiff Leonard Sokolow in a class action against Defendants LJM Funds Management, Ltd. and Anthony Caine (“LJM Defendants”), wherein Plaintiff alleged that the LJM Defendants violated various securities laws. The Settlement does not resolve claims against any other Defendant in this Action. There is no guarantee that any additional money will be recovered. The LJM Defendants deny any wrongdoing in this lawsuit.  The Court did not decide in favor of either the Plaintiff or the LJM Defendants.
  • The purpose of the Notice is to inform you of the pendency of a proposed settlement in this Action, and the hearing to be held by the Court to consider: (i) whether the Settlement should be approved; (ii) whether the Settlement Class should be certified; (iii) whether the proposed plan of allocation should be approved; (iv) Class Counsel’s motion for attorneys’ fee and expenses; (v) Class Counsel’s request for a service award for the Plaintiff; and (vi) any other matter related to the Settlement that the Court deems appropriate. 
  • The Notice describes important rights you may have if you are a member of the Settlement Class and what steps you must take if you wish to participate in the Settlement, wish to object, or wish to be excluded from the Settlement Class.
  • The Settlement with the LJM Defendants in this Action is separate and independent from a pending settlement in a federal case with the same name (Sokolow v. LJM Funds Management, Ltd., et al.), but which is pending in the United States District Court for the Northern District of Illinois, Case No. 1:18-cv-01039 (“Federal Action”).  The settlement in the Federal Action is with defendants other than the LJM Defendants.  If you are a class member in one of the cases, you are very likely to be a class member in the other case, and more importantly, you may recover in both cases if you timely file claim forms in both cases. 
  • If you are a Class Member, your legal rights will be affected by this Settlement whether you act or do not act.  Please read the Notice carefully.

The Settlement Class consists of: 

all persons and entities who purchased or otherwise acquired shares of the LJM Preservation and Growth Fund between February 28, 2015 and February 7, 2018, inclusive, whether or not those shares were Class A, Class C or Class I (LJMAX, LJMCX, or LJMIX).   

Excluded from the Class by definition are certain persons and entities (see paragraph 12 of the Notice) or those who request exclusion pursuant to the instructions set forth in the Notice (see paragraphs 32 to 35 of the Notice).

Payments to eligible claimants will be made only if the Court approves the Settlement and a Plan of Allocation, only after any appeals are resolved, and after the completion of all claims processing. Please be patient, as this process will take some time to complete.

IMPORTANT DATES

April 30, 2020

Claim Filing Deadline. Claim Forms must be received no later than April 30, 2020, to be eligible for a payment from the Settlement.

January 13, 2020

Exclusion Deadline. To exclude yourself from the Class, you must submit a written request for exclusion so that it is received no later than January 13, 2020, in accordance with the instructions in the Notice.

March 2, 2020

Objection Deadline. Any objections to the proposed Settlement, the proposed Plan of Allocation, and/or the request for attorneys’ fees and reimbursement of expenses, must be submitted or filed no later than March 2, 2020, in accordance with the instructions in the Notice.

June 3, 2020, at 11:00 a.m.

The Settlement Hearing. The Settlement Hearing will be held on June 3, 2020, at 11:00 a.m., before the Honorable Raymond Mitchell at Courtroom 2601, Daley Center, 50 W. Washington Street, Chicago, IL 60602.  The Court reserves the right to approve the Settlement, the Plan of Allocation, Class Counsel’s motion for an award of attorneys’ fees and expenses, and/or any other matter related to the Settlement at or after the Settlement Hearing without further notice to the members of the Class.
